Legal Charges Filed Against Captain and Pilot After Fatal Tjörn Maritime Collision

On the evening of July 28, 2023, a tragic maritime collision occurred near the islands of Katten and Lövön, southeast of Tjörn, Sweden, involving the Norwegian-flagged bulk carrier Misje Verde and a recreational boat. The incident resulted in the deaths of a woman in her 40s and a child, while a man and another child were seriously injured and hospitalized.

The Swedish Prosecution Authority has now announced the prosecution of both the 50-year-old captain of the Misje Verde and the Swedish pilot for causing death and injury due to negligence in maritime traffic. According to the indictment, both failed to maintain proper lookout, leading to the vessel striking the smaller recreational boat that was clearly visible on radar displays and the ship’s black box recordings.

Prosecutor James von Reis noted the unusual step of prosecuting a pilot, explaining that the pilot had taken an active role in the vessel's navigation and allowed the captain to attend to other duties unrelated to navigation such as lookout duties, which contributed to the accident. Both defendants deny any wrongdoing.

Eyewitness accounts, including that of the father on board the recreational boat, describe the harrowing moments when their boat was sucked under the cargo ship's bow, with the father trapped underwater in darkness before being able to escape. The accident has raised serious safety concerns in the area around Tjörn.

This case has proceeded swiftly due to police efforts and the availability of crucial evidence from the ship’s black box and radar data. The investigation emphasizes failure in following maritime navigation rules, specifically the vessel’s obligation to yield to the recreational boat.
